Terms of Service.
1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Human Performance Design Solutions, LLC ("HPDS," "RAZE," "we," "us," or "our"), which operates the RAZE™ application and website (together, the "Service"). By creating an account, redeeming a beta code, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Wellness & Safety — Not a Medical Device
RAZE is a performance and wellness tool, not a medical device. It does not diagnose, treat, cure, or prevent any disease or condition. The neuro-state sessions, biometric readings, drills, and recommendations are for general wellness and informational purposes only. Consult a qualified healthcare professional before beginning any new performance, breathing, or wellness program, especially if you have a medical condition, are pregnant, or have any concern about your health. Use of RAZE is at your own risk. Stop and seek medical attention if you feel unwell during any session or drill.
3. AI-Generated Coaching
The RAZE™ Coach feature uses a third-party artificial-intelligence model (Anthropic's Claude) to generate personalized suggestions based on the goal and information you provide. AI-generated guidance is for general wellness and performance purposes only, may not always be accurate or complete, and is not a substitute for professional advice. You are responsible for how you use it, and the wellness and safety disclaimer above applies fully to any Coach output. How we handle the data sent to the AI provider is described in our Privacy Policy.
4. Eligibility & Age Requirements
RAZE is intended for users ages 13 and older. Users under 13 are not permitted to create an account or use the Service. If you are between 13 and 17, you may use RAZE only with the review and consent of a parent or legal guardian, who must agree to these Terms and our Privacy Policy on your behalf — including consent to the on-device biometric scan. By using RAZE, you represent that you meet these requirements and that all information you provide is accurate.
5. Biometric Scan & Your Data
RAZE uses your device camera to run a brief (approximately 30-second) scan that estimates metrics such as heart rate, heart-rate variability, and breathing rate. The scan is processed on your device. RAZE does not store or transmit facial images or video — only the derived metrics are saved to your account while it is active. 6. Accounts
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Use a valid email address and keep your information current. Notify us promptly at info@thehpds.com if you suspect unauthorized use. You use the same RAZE account across the website and the app.
7. Memberships, Trials & Billing
RAZE requires a membership to unlock full access. Paid plans may begin with a free trial; you will not be charged until the trial ends, and you may cancel any time before then at no cost. Subscriptions renew automatically at the then-current price until cancelled. Payments are processed by Stripe; RAZE does not see or store your card details. You can change or cancel your plan from your account, with changes taking effect at your next billing date. Except where required by law, payments are non-refundable. Beta or pilot access may be provided at no charge and may be modified or discontinued at any time.
8. Acceptable Use
You agree not to: (a) share, resell, or transfer your account or access; (b) reverse engineer, copy, or create derivative works from the Service; (c) interfere with or disrupt the Service or its security; (d) use the Service for any unlawful purpose; or (e) upload content that is illegal, harmful, or infringes others' rights. We may suspend or terminate accounts that violate these Terms.
9. Community & Coach Features
If you post content or messages in Clubs, teams, or coach features, you are responsible for that content and grant RAZE a license to display it within the Service to deliver those features. Be respectful; harassment, abuse, and objectionable content are not tolerated and may result in removal or account termination.
10. Surveys, Feedback & Pilot Programs
From time to time — particularly if you take part in a team, pilot, or beta program — we may invite you to complete a short survey or give feedback about the Service. Participation is entirely voluntary. Declining to take part will not affect your access to the Service, your membership, or your standing on any team.
Your individual survey responses are not shared with your coach, team, or school. Coaches and program staff receive only group-level summaries, as described in our Privacy Policy.
You agree that HPDS may use survey responses, feedback, and usage data in aggregated and de-identified form — meaning combined across participants so that you cannot reasonably be identified — to evaluate, operate, and improve the Service, and to describe outcomes publicly, including in research summaries, case studies, and marketing or investor materials. We will not publish your name, your individual responses, or any written comment attributable to you without your separate written permission.
If you send us ideas, suggestions, or improvement requests, you grant HPDS a perpetual, worldwide, royalty-free license to use them without obligation or compensation. You may ask us to delete your survey responses at any time by contacting info@thehpds.com.
11. Intellectual Property
The Service, including RAZE™, NRT™ (Neuro-Recalibration Technology™), all content, videos, drills, software, and branding, is owned by HPDS and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial use. All rights not expressly granted are reserved.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any results or metrics are accurate.
13. Limitation of Liability
To the fullest extent permitted by law, HPDS and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim will not exceed the amount you paid to RAZE in the twelve months before the claim.
14. Termination
You may stop using the Service and delete your account at any time via Delete Your Account. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including Sections 10–12) will survive.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date, and, where appropriate, we will notify you. Your continued use of the Service after changes take effect means you accept the revised Terms.
16. Governing Law
These Terms are governed by the laws of the United States and the state in which HPDS is organized, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
